A Lehighton-area chiropractic practitioner, charged with an alleged physical assault that occurred in April 2019, was positioned in Carbon County's Accelerated Rehabilitation Disposition probation program on Monday.
Dr. John DeMatte IV, 52, of Lehighton, appeared before President Judge Roger N. Nanovic II for the placement in the program for first-time offenders. DeMatte is the owner of DeMatte Chiropractic in Franklin Township.
Mahoning Township police charged DeMatte with intensified attack and 2 charges of basic assault.
According to court documents, on April 18, 2019, authorities went to a local healthcare facility to meet an assault victim. The woman had a shiner, a cut on her chin, and second-degree burns on her back and best arm.
She informed officers that on the morning of April 13, 2019, DeMatte tossed a hot compound on her. She stated he then pushed her to the ground, punched her in the face, and dragged her throughout the flooring by her hair.
She stated the attack followed an argument which began the night before.
DeMatte was jailed that day on the attack charges and sent to Carbon County Correctional Facility and later on released on bail.
Assistant District Attorney Jennifer Rapa stated the victim of the attack, DeMatte's wife, accepted the ARD positioning.
Nanovic put DeMatte in the program for 2 years and ordered he pay an evaluation of $450 for the cost of the program, get both alcohol and drug and psychological health assessments and follow any suggestions for treatment, effectively finish an anger management course, continue his present therapy, pay court expenses of about $1,000 and pay a $50 per month supervision cost while in the program.
If he successfully complete the program, his record will be wiped clean. Nevertheless, if he stops working to finish it, or is revoked from the program, he will have to stand trial on all pending charges. A person does not confess guilt in going into the program.
